Overview

Welcome to Evolve Nutrition. The terms “Evolve Nutrition,” “we,” “us” and “our” refer to Evolve Nutrition.

We operate this website, online store and the related content, features, products, customer-support channels and services available through it (collectively, the “Services”). Our online store is powered by Shopify.

These Terms of Service (“Terms”) explain the conditions that apply when you visit our website, place an order or otherwise use the Services.

By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, you should not use the Services.

Nothing in these Terms limits any consumer right or remedy that cannot legally be limited or excluded under applicable law.

1. Eligibility and Accounts

By using the Services, you confirm that you are at least the age of majority in your jurisdiction or that you are using the Services with the authorization and supervision of a parent or legal guardian.

You agree to provide accurate, current and complete information when placing an order, creating an account or communicating with us.

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account. Please notify us promptly if you believe your account has been accessed without authorization.

We reserve the right to refuse, suspend or terminate an account when we reasonably believe it is being used unlawfully, fraudulently or in violation of these Terms.

2. Products and Product Information

We make reasonable efforts to display product descriptions, photographs, ingredients, sizes, flavors, quantities and prices accurately.

Product colors, packaging, labels or appearance may differ slightly from what appears on your screen. Manufacturers may also update packaging or product formulations without prior notice. Where a manufacturer changes a formulation, the information printed on the product received should be reviewed before use.

Product images may be provided for illustration. You are responsible for reviewing the product name, size, flavor, ingredients, allergen information and other relevant details before purchasing or using a product.

We may modify product descriptions, correct information, limit quantities or discontinue products when reasonably necessary.

All products are subject to availability. Placing an item in your cart does not reserve it.

3. Health and Supplement Information

Information provided through the Services is for general product and educational purposes only. It is not medical advice and is not intended to diagnose, treat, cure or prevent any disease or medical condition.

Individual needs and responses to supplements vary. Before using a supplement, review the product label, ingredients, allergens, warnings and manufacturer’s instructions.

Consult a qualified doctor, pharmacist or other healthcare professional before using a supplement if you:

Are pregnant or breastfeeding;
Are under medical supervision;
Have a health condition;
Take medication;
Have allergies or intolerances; or
Are uncertain whether a product is appropriate for you.

Do not exceed the manufacturer’s recommended serving unless instructed by a qualified healthcare professional. Stop using a product and seek appropriate medical guidance if you experience an unexpected or concerning reaction.

Any product guidance provided by Evolve Nutrition is general information and does not replace individualized advice from a qualified healthcare professional.

4. Orders

Submitting an order constitutes an offer to purchase the products in that order.

An automated order confirmation acknowledges that we received your order; it does not necessarily mean the order has been accepted. We may verify product availability, customer information, delivery details and payment status before accepting an order.

An order is accepted when we confirm it for fulfillment, dispatch it or otherwise expressly confirm acceptance.

We may decline, modify or cancel an order for legitimate reasons, including:

Product unavailability;
Incorrect product or pricing information;
Suspected fraud or unauthorized activity;
Incomplete or inaccurate customer information;
Delivery limitations;
Payment failure; or
Violation of these Terms.

If we change or cancel an order, we will attempt to contact you using the details provided during checkout. If payment has already been collected for a cancelled item, the applicable amount will be refunded.

Please review your order carefully before submitting it. Requests to modify or cancel an order are not guaranteed after processing or dispatch has begun.

Purchases are subject to our Refund and Return Policy.

5. Prices, Payment and Billing

Prices are displayed in the currency shown on the website, normally United States dollars unless otherwise indicated.

Prices, discounts and promotions may change without notice. A change will not ordinarily affect an order that we have already accepted, except when there is an obvious pricing or technical error.

Delivery charges and any other applicable fees will be displayed or communicated before the order is completed, whenever reasonably possible.

You agree to provide accurate billing and payment information and confirm that you are authorized to use the payment method selected.

Available payment methods may include cash on delivery, electronic payment or other methods displayed at checkout. The availability of a payment method may depend on the order, delivery area or service provider.

For cash-on-delivery orders, payment must be made in the agreed amount when the order is delivered. We may contact you to confirm the order before dispatch.

Payment-card details are processed by Shopify or the applicable payment provider. Evolve Nutrition generally does not directly store complete payment-card details.

6. Promotions and Discount Codes

Promotions and discount codes may be subject to separate conditions, including validity periods, eligible products, minimum spending requirements and usage limits.

Unless expressly stated otherwise:

Discounts cannot be exchanged for cash;
Multiple discount codes cannot be combined;
A promotion is subject to product availability; and
A discount cannot be applied retrospectively to a completed order.

We may cancel or correct a promotion affected by fraud, misuse or a genuine technical or pricing error, subject to applicable law.

7. Shipping and Delivery

We deliver to the locations made available through our website or confirmed through our customer-support channels.

Delivery times are estimates and may be affected by the delivery destination, carrier availability, public holidays, weather, security conditions or other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate delivery address and an accessible telephone number. Additional delivery costs caused by incorrect information, repeated failed delivery attempts or an unjustified refusal to receive a confirmed order may be charged to the customer where permitted.

Please inspect the order upon delivery. If an order is missing, damaged, defective or incorrect, contact us promptly at ordertoevolve@gmail.com or through WhatsApp at +961 76 040 262.

We will work with the customer and delivery provider to investigate legitimate delivery issues. Nothing in this section limits rights that cannot legally be excluded.

8. Returns, Exchanges and Refunds

Returns, exchanges and refunds are governed by our Refund and Return Policy.

Because supplements and food products are consumable goods, opened or used products and products with removed or broken protective seals generally cannot be returned for health, hygiene and safety reasons, unless the product was received damaged, defective or incorrect.

Do not send a product back before receiving return authorization and instructions from Evolve Nutrition.

9. Authenticity and Storage

We make reasonable commercial efforts to source authentic products from suppliers we consider reliable.

Customers must follow all storage instructions printed on the product. Products should generally be kept sealed and stored in a cool, dry place, away from excessive heat, moisture and direct sunlight, unless the manufacturer provides different instructions.

We are not responsible for deterioration or damage resulting from improper handling or storage after delivery.

10. Intellectual Property

The Evolve Nutrition name, logo, branding, website design and original website content are owned by or licensed to Evolve Nutrition and are protected by applicable intellectual-property laws.

Product names, trademarks, packaging and brand materials belonging to third-party manufacturers remain the property of their respective owners.

You may use the website for lawful, personal and non-commercial purposes. Without prior written permission, you may not reproduce, republish, modify, distribute, sell or commercially exploit our original content, branding or website materials.

Nothing in these Terms transfers ownership of any intellectual-property right to you.

11. Reviews, Feedback and User Content

If you submit a review, photograph, comment, suggestion or other content to us, you confirm that:

You have the right to submit it;
It is accurate to the best of your knowledge;
It does not violate another person’s rights;
It is not unlawful, abusive, deceptive or defamatory; and
It does not contain malicious software or unauthorized promotional content.

You grant Evolve Nutrition a non-exclusive, worldwide, royalty-free license to use, reproduce and display submitted content for operating, improving and promoting the Services, subject to applicable privacy law.

We may moderate or remove content that violates these Terms. We are not required to publish or respond to every submission.

12. Third-Party Services and Links

The Services may include links to or features provided by Shopify, payment providers, delivery services, social-media platforms and other third parties.

Third-party services are governed by their own terms and privacy policies. We do not control and are not responsible for third-party content, security, availability or practices, except to the extent responsibility cannot legally be excluded.

The inclusion of a third-party link does not necessarily constitute an endorsement.

13. Relationship With Shopify

Our online store is hosted by Shopify. However, products purchased through the store are sold by Evolve Nutrition, not Shopify.

Evolve Nutrition is responsible for its products, pricing, order fulfillment, delivery arrangements, returns and customer support. Shopify is not the seller of the products displayed by Evolve Nutrition.

Personal information processed through the store is handled in accordance with our Privacy Policy and, where applicable, Shopify’s privacy policy.

14. Errors and Availability

Our website may occasionally contain typographical errors, technical errors, inaccurate descriptions, incorrect prices or outdated availability information.

We may correct genuine errors, update information or cancel an affected order. If an accepted order is cancelled after payment has been collected, we will refund the applicable amount.

We do not guarantee that the Services will always be uninterrupted, secure or error-free, but we will make reasonable efforts to maintain their availability and correct material problems.

15. Prohibited Uses

You may not use the Services:

For an unlawful, fraudulent or malicious purpose;
To violate another person’s intellectual-property, privacy or legal rights;
To submit false or misleading information;
To impersonate another person;
To transmit viruses, malware or harmful code;
To interfere with the operation or security of the Services;
To collect personal information about others without authorization;
To send spam or unauthorized promotional communications;
To attempt to gain unauthorized access to an account or system; or
To copy, scrape or commercially exploit the Services in a manner that violates applicable law or our rights.

We may restrict or terminate access when we reasonably believe these Terms have been violated.

16. Disclaimer of Warranties

To the extent permitted by applicable law, the website and Services are provided on an “as available” basis.

We do not guarantee that the website will always be uninterrupted or completely free of technical errors. Information provided through the Services is general information and should not be treated as medical or professional advice.

Products remain subject to any warranties, protections or remedies provided by their manufacturer and applicable consumer law.

Nothing in these Terms excludes or limits a warranty, consumer protection or other right that cannot legally be excluded or limited.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Evolve Nutrition will not be liable for indirect, incidental or consequential losses arising from use of the Services when such losses were not reasonably foreseeable.

We are not responsible for losses caused solely by:

Incorrect information provided by the customer;
Use of a product contrary to its label or manufacturer’s instructions;
Improper handling or storage after delivery;
An unauthorized modification of the product; or
Events outside our reasonable control.

Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, gross negligence, defective products, personal injury or any other liability that cannot legally be excluded or limited.

18. Indemnification

To the extent permitted by applicable law, you agree to be responsible for losses or claims resulting from your unlawful use of the Services, your material violation of these Terms or your infringement of another person’s rights.

This section does not require a customer to compensate Evolve Nutrition for losses caused by Evolve Nutrition’s own unlawful conduct, negligence or breach of these Terms.

19. Termination

You may stop using the Services at any time.

We may suspend or terminate access to the Services when reasonably necessary because of fraud, unlawful activity, a security risk or a material violation of these Terms.

Termination does not affect rights or obligations that arose before termination. Provisions that are intended by their nature to continue will remain effective, including provisions concerning intellectual property, liability, payment obligations, privacy and dispute resolution.

20. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent legally permitted or removed to the minimum extent necessary.

The remaining provisions will continue in effect.

21. No Waiver

If we do not immediately enforce a provision of these Terms, this does not mean that we waive our right to enforce it later.

22. Entire Agreement

These Terms, together with the policies referenced in them and any specific promotion or offer conditions, constitute the agreement between you and Evolve Nutrition concerning use of the Services.

If a specific promotion or offer has separate conditions, those conditions apply to that promotion or offer.

23. Assignment

You may not transfer your rights or obligations under these Terms without our prior written consent.

We may transfer our rights or obligations as part of a legitimate transfer, restructuring or sale of the business, subject to applicable law.

24. Governing Law and Disputes

These Terms and the Services are governed by the laws of the Republic of Lebanon, without limiting any mandatory consumer protections that may apply.

The competent courts of Lebanon will have jurisdiction over disputes relating to these Terms or the Services, unless applicable law requires otherwise.

Before commencing formal proceedings, customers are encouraged to contact us so that we can attempt to resolve the issue directly.

25. Changes to These Terms

We may update these Terms to reflect changes to our Services, business practices or legal obligations.

The revised Terms will be published on this website with an updated revision date. Material changes will be communicated where required by applicable law.

Changes will apply from their stated effective date and will not retroactively reduce rights relating to an order already accepted, except where required by law.
